1. Company Information and Applicable Law.

The company here mentioned as "Leonardo del Principe", is hereinafter referred to as "LdP", "the company," "we," or "us,".

The company's legal domicile is in the Canton of Geneva, Switzerland. These Terms and Conditions are governed by Swiss law, with French as the reference language. By using this site or purchasing a print, you agree that Swiss law and jurisdiction, without regard to conflict of law principles, shall apply. In case of disputes, the resolution process is as follows:

1.   Contact us first for an amicable settlement.

2.   If unresolved, claims in English, French, German, or Italian may be submitted to the Swiss Authority for Internet Litigation: ombudsstelle@konsum.ch (Ombudsstelle E-Commerce, Belpstrasse 11, CH-3007 Bern, Switzerland).

3.   If necessary, lawsuits shall be brought before the Geneva Court: Tribunal de Première Instance (Place du Bourg-de-Four 1, Case postale 3736, CH-1211 Genève 3, Switzerland).

 

2. Copyrights and Trademark

 

All intellectual property on this site (photographs, texts, site layout and other documents) is protected under the Berne Convention for the Protection of Literary and Artistic Works (amended September 28, 1979, WIPO Treaty). Unauthorized use of Leonardo del Principe's work is prohibited and subject to prosecution. Unless otherwise stated, all photographs, prints, materials, trademarks, website content, and texts (including these Terms and Conditions) are copyrighted by Leonardo del Principe, Geneva, 2007-2025 (Article 15.3, Berne Convention).

 

Photographs on this site are film-based, serving as indisputable proof in copyright disputes.

 

Purchasing a print does not grant ownership of copyrights or usage rights; no reproduction is permitted. Leonardo del Principe retains all copyrights, display, and reproduction rights.

 

Photographs may be shared on social media for private, non-commercial use, provided they remain unaltered and include "Leonardo del Principe" and "Interior Art" mentions.

 

3. Limited Original Prints

 

All original prints sold on this site are strictly limited to 30 numbered copies across all sizes and finishes. Once a photograph reaches this limit, sales are discontinued. This limitation qualifies the prints as artworks under French law (CGI, Article 98a), one of the world's most restrictive law to protect the value of works of art, ensuring their rarity and potential value appreciation.

 

Prints are processed by Pictorial Service, 45b rue de la Roquette, Bastille, F-75011 Paris, France (Picto). Each print is secured with an unremovable Arttrust ™ seal and certificate, containing a reference number and QR code, verifiable on Arttrust Online. A certificate of authenticity, signed and dated by the artist, is sent separately. The series number (out of 30) is automatically assigned and cannot be requested or modified.

 

4. Gift Certificates

 

Gift certificates are valid for the specified product range and must be redeemed within one year unless otherwise stated. Discounts may apply at purchase, but gift certificates cannot be combined with promotions, vouchers, or other certificates. They do not apply to sold-out prints. A specific photograph cannot be reserved; the order is placed upon redemption.

 

Two types of gift certificates exist:

·        Fixed Value Certificate: The recipient can apply the chosen amount toward a purchase. If the print exceeds the certificate's value, the difference must be paid. No refund or compensation is provided for lower-priced prints.

·        Fixed Size and Finish Certificate: The recipient can order a print of the selected size and finish, which are guaranteed, even if prices increase.

 

5. Vouchers, Promotions, and Gifts

 

Promotions and vouchers are valid only for the specified products and timeframes. Promotions cannot be combined or applied to shipping costs. Vouchers and gift certificates are non-cumulative and cannot be used with promotions. Discounts on combined shipping can be added to promotions and vouchers.

 

Prints purchased under the "30% off first purchase" promotion are final sales: they are non-returnable, non-exchangeable, and non-refundable.

 

The free 4th print offer applies only when four prints from the same series (displayed together with a unified concept) are purchased and shipped simultaneously. It cannot be applied retroactively. The free print matches the size and finish of the other three; if finishes vary, it will default to the smallest. This offer is subject to availability within the 30-print limit.

 

As concerns "the 5^th offer". The 5th picture of a series is the one displayed in fifth position of the series. The 5th picture must be part of the series of which the customer already owns an original print. If unavailable, an alternative 5th picture from another series must be chosen. This print, like the other on the site, is limited to 30 copies and certified with an Arttrust seal. It is delivered in "S" size with aluminum mounting and free worldwide shipping. If an upgraded size or finish is desired, the price difference must be covered, but no refund applies for downgrades.

 

6. Orders Processing and Payment

All original prints are custom-made. The customer selects the photograph, size, and finish. Since prints are limited to 30, each order is unique and cannot be reprinted.

 

The customer submits a print request. We respond with an offer that includes a description of the requested product(s), along with details of the price and shipping costs and all the necessary information to proceed with the payment. An attached document titled "Art Prints" provides a precise product description. The Terms and Conditions in effect on the order date apply and are sent via email alongside the offer. Any modifications or corrections to the offer can be mutually agreed upon between the customer and us. If changes are made, they will be confirmed through a revised offer.

Payment of the offer constitutes acceptance. It also confirms agreement with the information on the order form, the Terms and Conditions, and the product description in the "Art Prints" document.

 

Orders are restricted to individuals of legal age in their country of residence. LdP reserves the right to refuse orders.

 

Payment can be made with the major credit card, through paypal, or with an email address without creating a Paypal account. The transaction is processed by Paypal which provides strong guarantees for purchase protection and personal data privacy. Direct IBAN transfers are possible upon request. Prices are in USD. Payments in EUR or CHF are possible upon request.

 

The print is processed only after having received your payment.

 

7. Delivery

 

Shipping rates are specified on the "art prints" page and added to the item price. Discounts may apply for combined shipping if all items are shipped together. Orders are processed after payment. Estimated delivery times (excluding processing, which takes 3 to 5 days):

 

·        Western Europe: 2-5 days

·        Central Europe: 5-10 days

·        USA: 5-8 days

·        Rest of the world: 8-15 days

 

Prints are shipped by Pictorial Service from Paris, France. A tracking number will be provided via email. Delivery times may be longer before Christmas and vary by country.

 

Products are produced and sent from Paris, France, European Union.

 

Customs and import taxes may apply and are the buyer's responsibility.

 

Under Swiss law (CO Article 185), the buyer is responsible for receiving the shipment. If undelivered check with neighbors and the local post office. Unclaimed returns will be reshipped at the customer’s expense.

8. Incorrect or Damaged Item

If the parcel shows visible damage upon delivery, you must refuse it or, at a minimum, note the damage on the delivery receipt. If you discover damage upon opening the parcel, take clear photographs of both the product and its packaging. Notify us immediately via email (see contact page) so we can report the issue to the carrier within the mandatory deadline of three working days from the delivery date. If this deadline is missed, the carrier is no longer liable, and we will be unable to exchange the item.

 

The faulty item must be returned to our provider, Picto (53 bis rue de la Roquette – F-75011 Paris, France), for assessment. If Picto approves the claim, the damaged photograph will be replaced at no cost to you, with shipping costs (both to and from the customer) reimbursed. Refunds will be credited to the original payment method. If Picto rejects the claim, the item will not be refunded, and return shipping will be at the customer’s expense.

 

Incorrect Item

If the print you receive does not match your order specifications (e.g., photograph, size, or finish), notify us immediately via email (see contact page) so we can contact the provider within the mandatory deadline of three working days from the delivery date

 

We will inform you whether to return the item to the provider or to us. You must take appropriate care when returning the item, ensuring it is securely wrapped, preferably in its original, undamaged packaging. We recommend using insured shipping, as we are not liable for lost or damaged goods during return transit. If the item does not match your order specifications, we will replace it free of charge, including reimbursement of shipping costs (both to and from the customer). Refunds will be credited to the original payment method. return the item.

 

9. 14-Day Return Guarantee

 

Before purchasing a print, you may request further technical guarantees.

If you are not fully satisfied with your print or simply change your mind, email us within fourteen calendar days of receiving the item to request a refund. We may ask for a reason to help improve our service, but this will not affect your right to return the item.

 

The item and its certificate of authenticity must be returned within three days of receiving our approval. You must ensure careful handling and secure packaging, preferably using the original undamaged packaging. We recommend insured shipping, as we cannot issue a refund for items lost or damaged in transit. The photograph and certificate must be in mint condition to be eligible for resale. The refund or any alternative agreement will be processed once the item is received and assessed.

 

The return policy applies only to the purchase price of the photograph and excludes shipping costs (both to and from the customer). Other shipping-related expenses are beyond our control and not covered under this policy.

Refunds will be credited to the original payment method and issued to the original purchaser.

 

Under Swiss law (link), there is no mandatory right of return. Our 14-day return guarantee is an exception to this rule. Since all prints on this site are custom-made upon order and limited to 30 editions, returned items count toward this limit. Due to the nature of the artwork and Swiss legal framework, the return guarantee is granted only once per customer (same name and address).

 

Gifts, discounts offered by Leonardo del Principe, and purchases marked as "sale is final" are excluded from this return policy and are neither refundable nor exchangeable. Items sold at professional rates are subject to a separate return process, please contact us for further details.

 

10. Privacy Policy

 

This site is governed by the Swiss Federal Act on Data Protection (link).

 

When purchasing a photograph, we do not receive or store your credit card details. PayPal is solely responsible for processing payment data, which is securely transmitted via SSL encryption.

 

The personal details you provide (name, delivery address, email, etc.) are used exclusively to process your order and will be shared only with our supplier, Pictorial Service in Paris, to fulfill the order. Customer data is not stored on our website for security reasons. Your data will never be sold, rented, shared, or disclosed to any third party under any circumstances.

 

You may request access to your personal data and ask for modifications or deletions. Occasionally, we may send promotional materials (e.g., vouchers, samples, calendars) to your postal address. You can opt out via the site’s contact form. If you subscribe to our newsletter, your email address will never be shared or sold. You may unsubscribe at any time by replying to the email.

 

Our website is encrypted with SSL for maximum security. Visiting the site does not disclose personal information. We only collect technical, non-personal data (e.g., browser type, operating system, IP address) to improve website usability. We do not track individual users. Like most e-commerce websites, we use cookies, which are small text files stored on your computer by your web browser. These do not contain personal information and are used solely to enhance website functionality. We use Google Analytics to assess site performance, which also relies on cookies. You may disable cookies in your browser settings, but doing so may limit site functionality.

 

11. Limitations of Liability

We take great care to ensure the digital display of images closely matches the final print. However, due to variations in screen displays, slight color differences may occur. The colors displayed on your screen are not legally binding. You may request additional technical information regarding resolution and color accuracy before purchase via the contact page. Minor size variations between the listed dimensions and the final print may also occur.

 

Improper handling or use of the photograph voids any right to a refund. Prints, even those laminated or under acrylic glass, must not be exposed to direct sunlight, placed outdoors, or in humid environments such as kitchens or bathrooms. They must not be placed near radiators. Surfaces are delicate and should be handled with gloves or similar protection. Any damage resulting from improper hanging or handling is the customer's responsibility.

 

We are not liable for uncollected items, incorrect delivery addresses, or undelivered items (Swiss Code of Obligations, Article 185.1).

 

We are not responsible for any financial damages, including but not limited to the cost of replacement purchases, due to late delivery.

 

Indirect damages are excluded.

 

We are not liable for any damages arising from the use of this website.
